GENERAL TERMS AND CONDITIONS

The terms and conditions govern the contractual relationship between you and Hotel Edelweiss Rigi AG, Staffelhöhenweg 61, 6356 Rigi Kaltbad, hereinafter referred to as Kräuterhotel Edelweiss.

  1. Area of application

These terms and conditions apply to the rental of hotel rooms, table reservations in one of the restaurants and all related services. The terms and conditions of the Kräuterhotel Edelweiss apply exclusively. The customer's terms and conditions shall not become part of the contract even if they are not expressly contradicted.

  1. Reservations

A contract is concluded between the organiser/guest when An offer from the hotel has been reconfirmed in writing by the organiser or A request from the customer has been confirmed in writing by the hotel or A booking was made via the homepage or another booking platform or A restaurant reservation was confirmed verbally by a member of staff over the telephone.
Offer for events / seminars / banquets
The acceptance period for offers made by the hotel is 14 days, unless a different period has been agreed. After this period, the Kräuterhotel Edelweiss is no longer bound by the offer. The hotel reserves the right to withdraw from an offer before the expiry of the acceptance period for good cause.

2.2. Options

Options are binding for both parties during the agreed option period. After expiry of the option period, the Kräuterhotel Edelweiss reserves the right to dispose of the reserved dates and services.

2.3 Offers

Offers for individual room requests are non-binding for 24 hours. Should the availability change within a short period of time, the hotel reserves the right to withdraw from the offer even within a shorter period of time.

  1. Change in the number of participants and event time
    The customer is obliged to inform the hotel as soon as possible of any changes in the number of participants. The Kräuterhotel Edelweiss will always endeavour to reallocate unused reservations under the same conditions. If this is successful, no costs will be charged to the organiser.
    The hotel must be informed of the exact number of participants at the latest 48 hours before the event.

    This information shall form the basis for invoicing. If
  2. individual services had not yet been determined at the time of the change in the number of participants, a flat rate of up to CHF 500.00 per person may be charged.

If individual collection is provided for an event, the costs for late cancellations (NO SHOW) will be charged to the organiser.

  1. Cancellation conditions

Cancellations must be notified to the hotel in writing as early as possible.

4.1. for events / seminars / group bookings, a cancellation period of 3 months applies unless otherwise agreed in writing.

4.2. ffor individual room bookings, unless otherwise agreed in writing, a cancellation period of 14 days applies.

4.3. For table reservations in the restaurant, unless otherwise agreed in writing, a cancellation period of 48 hours applies.

4.4. The same cancellation conditions apply to the hotel and the restaurants.
 

  1. Terms of payment

5.1. Best daily rate and restaurant

Payment on arrival or departure in cash or by credit card

5.2. Special offers / offers with discount

Payment on arrival or departure in cash or with EC-Direkt or Postcard (no credit card payment). In case of payment by credit card, the hotel reserves the right to charge the commission to the guest.

5.3. Individual collection for seminars / events

Payment on arrival or departure in cash or with EC-Direkt or Postcard (no credit card payment). In case of payment by credit card, the hotel reserves the right to charge the commission to the guest.

5.4. Restaurant consumptions

Hotel guests can have all restaurant consumptions written on the hotel room and pay with the hotel bill when checking out.

5.5. External guests pay the restaurant bill directly to the service in cash or with credit card

5.6. Payment on account

If payment by invoice has been agreed, these are due within 20 days of the invoice date without deduction. The services invoiced shall be deemed to have been provided in full and in due form if the organiser does not report any complaints within the payment period.

The Kräuterhotel Edelweiss reserves the right to request a deposit of 50% of the agreed services. For reservations with a foreign billing address or reservations from abroad, a deposit of 100% of the reserved services may be claimed. If the organiser or guest defaults on payment of the deposit, the hotel shall be entitled to withdraw from the contract in accordance with room 8.1 of these terms and conditions. The deposit will be charged to the costs in the cases of clauses 3 - 5 of these terms and conditions. In the event of default, the Kräuterhotel Edelweiss reserves the right to charge the costs for reminders, address investigations and credit checks including the fees of a lawyer. The organiser declares his agreement with the charging of these costs, also insofar as these are not or only partially refundable according to legal provisions.

 

  1. Withdrawal by the Kräuterhotel Edelweiss

The hotel is entitled to withdraw from the contract at any time for good cause and outside the cancellation deadlines that also apply to the guest. Important reasons are in particular official requirements and prohibitions, safety aspects and cases of force majeure as well as other circumstances beyond the hotel's control or influence. In these cases, the hotel shall assist in organising suitable replacement capacity. Furthermore, the Kräuterhotel may withdraw from the contract under the following conditions

  1. There is reasonable cause to believe that the event or its participants will jeopardise the smooth running of the business, the safety or the reputation of the hotel or its guests.
  2. The hotel determines that events were booked under misleading or false statements of material facts or for a purpose other than that communicated.
  3. Third parties who have been involved in the organisation of the event by the hotel at the instigation of the organiser shall be prevented from providing the service in whole or in part.

The hotel declares the withdrawal as soon as it becomes aware of the reasons justifying this and informs the organiser immediately. The organiser cannot assert claims for damages against the Kräuterhotel Edelweiss in any of the above cases.

 

  1. Liability

7.1. Services Hotel

The organiser shall be liable for the entire invoice amount including the services purchased by its employees, auxiliary staff and the event participants. Exceptions must be agreed in writing.

7.2. Damage

The organiser shall be liable for all damage and losses incurred by the hotel through him, his employees, support staff or event participants. Proof of fault is not required. The hotel may require the organiser to provide evidence of appropriate security (e.g. insurance, deposits, guarantees).

7.3. Theft

The Kräuterhotel Edelweiss is not liable for theft or damage to items brought in by the organiser, its employees, auxiliary persons or event participants.

7.4. Institution

Insofar as the hotel makes technical or other equipment available to the organiser or procures it from third parties, it shall act in the name and for the account of the organiser. The organiser shall be liable for the careful handling and return of the equipment and shall indemnify the hotel against all claims of third parties arising from the provision of the equipment.

 

  1. Pets

The guest who brings an animal to the hotel or restaurant is obliged to keep or supervise this animal properly during his stay. The guest must have appropriate pet owner insurance for his/her pet. Proof of the corresponding insurance must be presented when requested by the restaurant.

 

  1. Smoking

All interior rooms of the hotel are non-smoking. Smoking is permitted on the terrace and on the room balconies. In the event of non-compliance, the hotel reserves the right to charge the guest in full for the damage caused by special cleaning and the inability to sell the rooms.

 

  1. Food and drinks

10.1. Restaurant

All food and beverages are to be purchased exclusively from the restaurant. In special cases (specialities, etc.), a different written agreement may be made. In such a case, the restaurant is entitled to charge a service fee or corkage fee.

10.2. Hotel Rooms

The guest is free to take food and drinks to the room and consume them there. Cooking in the rooms is expressly prohibited.

 

  1. Lost property

Lost property will be kept by the hotel for at least 30 days. For reasons of personal privacy, the hotel does not inform the guest independently about found objects. Upon request, the lost property will be forwarded to the guest at the desired address. The guest shall bear the costs and the risk of forwarding.

  1. Illness of the guest

If a guest falls ill during his stay in the restaurant or hotel, the hotel shall notify a doctor at the guest's request. If the guest is no longer capable of acting and the hotel is aware of the illness, it may also notify a doctor without the guest's request. Medical care shall in any case be provided at the guest's expense.

 

  1. Final provisions

Amendments or additions to the contract, supplementary agreements or these terms and conditions must be made in writing. This also applies to the waiver of the written form requirement. Unilateral changes by the organiser are invalid.

13.1. The place of performance and payment is the registered office of the hotel.
13.2. Place of jurisdiction. The parties have agreed that Weggis shall be the exclusive place of jurisdiction for any differences regarding the contractual relationship or its initiation, supplementary agreements or these General Terms and Conditions. Swiss law is applicable.

13.3. Media. Advertisements in the media containing references to events booked at the Kräuterhotel Edelweiss require the prior written consent of the hotel.

13.4. Addendum. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. These shall be replaced by a permissible provision which corresponds as far as possible to the meaning and purpose of the invalid provisions. In all other respects, the Swiss Code of Obligations shall apply.

2. Processing of personal data and purposes of processing

a) When visiting the website
You can visit our website without revealing any information about your identity. The browser used on your end device only automatically sends information to the server of our website (e.g. browser type and version, date and time of access) to enable the website to establish a connection. This also includes the IP address of your requesting end device. This is temporarily stored in a so-called log file and automatically deleted after 3 days at the latest.
The IP address is processed for technical and administrative purposes of connection establishment and stability, in order to guarantee the security and functionality of our websites and to be able to pursue any illegal attacks on them if necessary.

We cannot draw any direct conclusions about your identity from the processing of the IP address and other information in the log file.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations of this in sections 4 and 5 of this data protection information.

b) When ordering as a guest

If you would like to order products as a guest via our website, we collect the following information as mandatory data:
- First and last name,
- address,
- e-mail address,

- Payment data, depending on the payment method you have selected (for example, credit card data, bank details or Paypal account data).

The collection of this data is done,
- to be able to identify you as our contractual partner;
- to check the plausibility of the data entered;
- to process payment for your order;
- to process any warranty claims and to assert any claims against you.

In order to ensure a smooth and easy processing of your order and for a quicker clarification of any queries, you can also provide the following additional data:
- Your telephone number and
- an alternative delivery address.
The provision of this data is voluntary.

The personal data collected by us for the order will be stored until the expiry of the legal warranty obligation and then deleted, unless we are obliged to store the data for a longer period due to tax and commercial law retention and documentation obligations or you have consented to storage beyond this period. The legal basis for processing the data for this purpose is your consent pursuant to Art. 6 (1) lit. a EU-DSGVO.

c) When setting up a user account
You have the option of setting up a password-protected user account with us, in which we store your personal data. The purpose of this is to provide you with the greatest possible convenience in processing your orders by making the purchase process easier, faster and more personal.

If you wish to set up a password-protected user account with us, we require the following information from you:

- First and last name,
- address,
- e-mail address,
- Payment data, depending on the payment
method you have selected (for example, credit card data, bank details or Paypal account data).

For faster clarification of any queries, you can also provide your telephone number. This information is voluntary and not required for setting up the user account.

The processing of your personal data is carried out upon your request and is necessary for the aforementioned purposes for the use of our service and thus for the fulfilment of the contract and pre-contractual measures in accordance with Art. 6 para. 1 lit. a EU-DSGVO.

The creation of a user account is not necessary for the use of our site or for orders you wish to place with us. We offer you the possibility to place your order as a guest (see under point 2. b). In this case, however, you will have to enter your data again completely for each order.

You can delete your user account at any time by sending an email to info@gudrunsjoeden.de.

After deletion of your user account, your data will be deleted for further use, unless we are obliged to store it for a longer period of time according to Art. 6 para. 1 lit. a EU-DSGVO due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to the storage beyond this according to Art. 6 para. 1 lit. a EU-DSGVO.

d) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 Para. 1 lit. a EU-DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an e-mail address. You may also voluntarily provide your name. This is used to address you personally in the newsletter.

You will then receive a registration notification by e-mail, which you must confirm in order to receive the newsletter (so-called double opt-in). This serves as proof for us that the registration was actually initiated by you.

You can unsubscribe at any time, e.g. via a link at the end of each newsletter. Alternatively, you are welcome to send your unsubscribe request at any time by e-mail to willkommen@kraeuterhotel.ch

Your e-mail address will be deleted immediately after you withdraw your consent to receive the newsletter.

e) For other purposes
In addition, we will only pass on your personal data to third parties if:
- you have given your express consent in accordance with Art. 6 Para. 1 lit. a EU-DSGVO;
- in the event that there is a legal obligation to pass on the data in accordance with Art. 6 Para. 1 lit. a EU-DSGVO.

4. Cookies und Pixel-Tags

We use cookies on our websites. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.
Information is stored in the cookie that is related to the specific end device used. However, this does not mean that we gain direct knowledge of your identity.

5. Tracking and targeting
The tracking and targeting measures listed below and used by us are carried out on the basis of Art. 6 para. 1 lit. a EU-DSGVO.
With the tracking and targeting measures used, we want to ensure a needs-based design and the ongoing optimisation of our websites. On the other hand, we use the tracking measures to statistically record the use of our websites. Furthermore, we use the data for the optimised playout of advertising content.

By means of the targeting measures used, we want to ensure that you are only shown advertising on your end devices that is oriented to your actual or presumed interests. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

Right of withdrawal

Tickets can be returned up to 14 days before the event. No additional costs will be incurred. Returns from 13 days until the date of the event will be charged in full.

You have the right to cancel this contract within fourteen days of its conclusion without giving any reason and to return the goods to

If you revoke this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the goods arrived at unds. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You shall bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

General information

1) Please avoid damage and contamination of the goods. If possible, please return the goods to us in the original packaging with all accessories and with all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
2) If possible, please do not return the goods to us freight collect.
3) Please note that the aforementioned items 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
